Terms of Use

M/s. Talentmandi Services Private Limited ("Talentmandi" or the "Company") operates this portal ("Talentmandi.com" or "Portal") to provide on-line services to avail employment opportunities (“Candidate”), use profiles/information/details for employing the Candidate (“Organizations”). By accessing and using this Portal, you (“You”) agree to each of the terms herein contained (“Terms of Use”), if you do not accept the Terms of Use stated herein, do not use the Portal and its services. Talentmandi reserves the right to modify Terms of Use at any time in its sole and absolute discretion. The most current version of the Terms of Use will supersede all previous versions. Any such modifications will become effective immediately upon posting to the Portal and your continued use of the Portal /services constitutes your agreement to be bound by such changes. The terms may be modified as frequently as desired, and at Talentmandi’s sole and absolute discretion. You are advised to regularly visit the Terms of Use page to keep yourself updated with our terms and conditions to avoid any breach.

1. Eligibility & Indemnification:

You must be 18 years of age or older to visit or use the Portal in any manner. You understand and agree that you are personally responsible for your behavior on the Portal. You agree to indemnify, defend and hold harmless Talentmandi from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of your use, misuse, or inability to use the Portal, the service, or any violation by You of this Terms of Use.

2. Use of Services:

Your use of the Talentmandi Services is also subject to any other contracts You may have with Talentmandi. In the case of any conflict between these terms and any contract you have with Talentmandi, the terms of your contract will prevail.

3. User Conduct:

You agree to use the Portal only for lawful purposes. You agree not to take any action that might compromise the security of the Portal, render the Portal inaccessible to others or otherwise cause damage to the Portal or its content. You agree not to use the Portal in any manner that might interfere with the rights of third parties.

4. User Content, Copyright & Trademark:

Talentmandi welcomes feedback regarding any areas of Talentmandi’s existing businesses that will help satisfy customer's needs, and feedback can be provided through contact details on the Portal. Your idea will automatically become the property of Talentmandi, without any compensation to you. Talentmandi will have no obligation to return your idea to you or respond to you in any way; Talentmandi will have no obligation to keep your idea confidential; and may use your idea for any purpose whatsoever, including giving your idea to others.

You are prohibited from using any of the marks or logos appearing throughout the Portal without permission from the Trademark owner “Talentmandi”. You are prohibited from copying any content from the Portal.

The contact details given by the Candidates and Organizations shall be correct. Any change in the contact information has to be updated in the Portal from time to time by respective parties. Talentmandi is not responsible to the respective party or any third party whose information is being shared on the Portal for any kind of data loss or mis-communication. Talentmandi will only give administrative support for any grievances.

5. Password Security:

You are responsible for maintaining the confidentiality of your log in and password information, and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your log in and password. You agree to immediately notify the Company of any unauthorized use of your account, and passwords.

6. Terms of Payment:

a)  An online payment system is provided by Talentmandi and its third party suppliers. All prices for Domestic users (India) will be quoted in INR and all prices for International users will be quoted in USD. Talentmandi reserves the right to change the fees at any time. Your payment will be through merchant gateway facility of CC Avenue. However Talentmandi may also accept payments through cheques or NEFT/RTGS or any other direct modes and make available the services of the Portal directly. We cannot accept liability for a payment not reaching Talentmandi account due to you quoting an incorrect account number or incorrect personal details. Neither can we accept liability if payment is refused or declined by the credit/debit card supplier for any reason.

b) If the card supplier declines payment, Talentmandi is under no obligation to bring this fact to your attention. You should check with your bank/credit/debit card supplier that payment has been deducted from your account. There is no refund policy in Talentmandi.

c) All payment details which are entered through this payment gateway are encrypted when the user making the payment enters them. Communications to and from the service provider's site are encrypted.

7. Restriction and Termination of Use:

Talentmandi at its sole discretion, without prior notice to you or liability to Talentmandi, may block, restrict, disable, suspend or terminate your access to all or part of the Portal, services at any time if you violate the terms and conditions or resort to any unlawful action, specifically, after a period of inactivity, Talentmandi reserves the right to disable or terminate a user's account. If an account has been deactivated for inactivity, the user name associated with that account may be given to another user without notice to you or such other party.

8. Consequences of Non-Compliance of This Code:

Talentmandi at its sole discretion, without prior notice to you or liability to Talentmandi, may block, restrict, disable, suspend or terminate your access to all or part of the Portal, services at any time if you violate the terms and conditions or resort to any unlawful action, specifically, after a period of inactivity, Talentmandi reserves the right to disable or terminate a user's account. If an account has been deactivated for inactivity, the user name associated with that account may be given to another user without notice to you or such other party.

a) Any violation of the Terms of Use will not be tolerated and shall attract prompt and punitive disciplinary action up to and including termination of usage rights as well as legal action. In the event of termination, users found in violation of the code of conduct will not receive any credit or payment or refund from Talentmandi.

b) Without limiting Talentmandi of other remedies, to the extent you are in violation of the Terms of Use, you must reimburse us for all losses and costs (including any and all Talentmandi employee time) and reasonable expenses (including legal fees) related to investigating such breach and collecting such fees. In the event of termination, you will have no claim whatsoever against Talentmandi in respect of any such suspension or termination of your membership.

9. Additional terms and conditions for Organizations:

Talentmandi does not provide resume database. It gives limited number of pre-screened and shortlisted candidates' details/resume to the Organizations as per its needs and on mutual terms by effectively acting as a recruitment consultant. Organizations may note that Talentmandi processes the information given by the Candidates and is not responsible for any errors in the profiles/details submitted to the Organization.

Talentmandi is not directly or indirectly responsible for any decision or consequences of any decision, taken on the basis of the assignment i.e. Portal deliverables, its outputs and consequences. The responsibility for the final decision would rest solely with the Organization. Talentmandi may insist the Organizations to separately sign this Terms of Use or any other relevant documents to govern its relationship with the Organizations.

Talentmandi acts only as a candidates’ screening and curation service. Based on the packages opted by the company, Talentmandi accordingly shares the number of curated profiles with the organization. The responsibility of final selection and retention of the candidates vests with the company. Commitment from Talentmandi will be only to share the curated profiles and we do not take any responsibility towards interview process or final selection of the candidate.

10. Additional terms and conditions for Candidates:

Talentmandi provides all Candidates (Job seeker) a platform to register and apply for jobs. Talentmandi does not guarantee a job for registering the details on the Portal. Talentmandi doesn’t guarantee a job or shortlisting for a job, but will actively process to find a matching opportunity.

The resume/ insertion or information/data fed by the Candidate can be updated by him alone. Talentmandi would not be held liable for loss of any data technical or otherwise, or of the resume/ insertion or information/data or particulars supplied by the Candidate due to acts of god as well as reasons beyond its control like corruption of data or delay or failure to perform as a result of any cause(s) or conditions that are beyond Talentmandi's reasonable control including but not limited to strikes, riots, civil unrest, Government policies, tampering of data by unauthorized persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.

It shall be the sole prerogative and responsibility of the Candidate to check the authenticity of all or any response received pursuant to the resume/ insertion or information/data being fed into the network system of Talentmandi by the Candidate, for going out of station or in station for any job or interview. Talentmandi assumes no responsibility in respect thereof and expressly disclaims any liability for any act, deed or thing which the user may so do, pursuant to the receipt of the response, if any, to the resume/ insertion or information/ date being fed into the network system of Talentmandi.

The Candidate shall be assigned a password by Talentmandi to enable them to access all the information received through the Portal, but the sole responsibility of the safe custody of the password shall be that of the Candidate and Talentmandi shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. Talentmandi undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.

By using the Portal, the Candidate represents and undertakes as follows:

• He / She have proper authority to search for Organizations on this Portal and the information which he/she are giving is genuine.

• He / She shall not contact the Organization in any other way or means outside the Portal.

• The Candidates expected to maintain utmost confidentiality with respect to any information as a part of the recruitment cycle

If any of the above terms are violated, Talentmandi shall at its sole discretion block the violating party for using the part or all functionalities/features of the Portal without any refund of fee paid.

11. Disclaimer of Warranties and Liability:

Certain links on the Portal lead to resources located on servers maintained by third parties over whom Talentmandi has no control or connection, business or otherwise as these sites are external to Portal, You agree and understand that by visiting such sites You are beyond the Portal. Talentmandi therefore neither endorses nor offers any judgment or warranty and accepts no responsibility or liability for the authenticity/availability of any of the goods/services/or for any damage, loss or harm, direct or consequential or any violation of local or international laws that may be incurred by your visit and/or transaction/s on these sites.

12. Special Admonitions for International Use:

Recognizing the global nature of the Internet, You agree to comply with all local rules regarding online conduct. Specifically, You agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.

13. Advertising Material:

Part of the Portal may contain advertising/other material submitted to Talentmandi by third parties. Responsibility for ensuring that material submitted for inclusion on the Portal complies with applicable International and National law is exclusively on the advertisers and Talentmandi will not be responsible for any claim, error, omission or inaccuracy in advertising material. Talentmandi reserves the right to omit, suspend or change the position of any advertising material submitted for insertion. Acceptance of advertisements on the Portal will be subject to Talentmandi terms and conditions which are available on request.

14. Force Majeure:

Talentmandi shall have no liability to you for any interruption or delay in access to the Portal irrespective of the cause.

15. General Provisions:

a) These Terms of Use constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by Talentmandi of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

b) The Terms of Use may contain typographical errors or other errors or inaccuracies and may not be complete or current. Talentmandi therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update the Terms of Use at any time without prior notice. Talentmandi does not, however, guarantee that any errors, inaccuracies or omissions will be corrected.

16. Settlement by Arbitration:

Any claim or controversy that arises out of or relates to this Terms of Use and breach of it, the same shall be referred to a person nominated by the Company whose decision shall be final and binding upon the parties hereto. Such references shall be deemed to be a submission to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

17. Governing Law and Jurisdiction:

This Portal is controlled by Talentmandi from its offices located at Hyderabad, India. By accessing this Portal, you agree that all matters relating to your access to, or use of, this Portal shall be governed by laws applicable to jurisdiction applicable in Hyderabad. In case of any litigation it is agreed by both the parties that only Courts in Hyderabad will have exclusive jurisdiction to try any matter to the exclusion of all other Courts.
